Official Sweepstakes Rules
NO PURCHASE NECESSARY TO ENTER OR TO WIN. A purchase will not increase chances of winning a prize.
Sweepstakes Period: The entry period for the “Win a Year’s Worth of Pizza” Sweepstakes (the “Sweepstakes”) begins on May 6, 2024 and ends on May 20, 2024 (the “Sweepstakes Period”).
How To Enter: Visit a participating retail establishment offering the Hunt Brothers® Pizza “Win a Year’s Worth of Pizza” Sweepstakes during the Sweepstakes Period and look for the Entry Box and an Official Entry Form. Fill out an Official Entry Form in its entirety and place it in the Entry Box. Limit one (1) Sweepstakes entry over course of the Sweepstakes Period per person, household, email address, or mailing address. No group or bulk entries allowed. Entries over this limit are void.
Eligibility: Sweepstakes open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia (“DC”) who are eighteen (18) years of age or older or of the age of majority in their state of residence, whichever is older on the date of Sweepstakes entry. Void where prohibited. Employees of TBHC Delivers, LLC (the “Sponsor”), its subsidiaries, affiliates, divisions, advertising and promotion agencies, individuals engaged in the development, production or distribution of materials for this Sweepstakes and the immediate families of each, or persons domiciled in the same household of such employees are not eligible. Sweepstakes is governed by Tennessee law and is subject to all applicable federal, state and local laws. By entering the Sweepstakes, entrants agree to be bound by these Official Sweepstakes Rules and the decisions of the Sponsor, which shall be final and binding in all respects.
Conditions of Entry: All entries become the property of Sponsor and will not be acknowledged or returned. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. By participating, entrants agree to release TBHC Delivers, LLC, Hunt Brothers Pizza, LLC, and their respective officers, directors, employees, agents or representatives (collectively, “Released Parties”) from and against any and all claims, demands, losses and liabilities of any nature whatsoever, which entrant may now or hereafter be entitled to assert, including but not limited to, any death, injury, loss of enjoyment, or other harm or loss of any nature whatsoever caused or contributed to by participation in the Sweepstakes. Released Parties are not responsible for late, lost, damaged, garbled, incomplete, or illegible entries or any combination thereof, for whatever reason. Sponsor reserves the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Random Selection of Winners: On or around May 21, 2024, a random drawing will be conducted by a participating retailer’s employee or designee from among all valid, eligible entries received over the course of the Sweepstakes Period to award the one (1) available prize. All decisions shall be final and binding in all respects. Odds of winning a prize depend upon the total number of eligible entries received during the Sweepstakes Period. Potential prize winners will be notified by email and/or phone call within twenty-four (24 hours) of the random drawing. Such potential prize winners will be required to reply to the prize notification attempt within five (5) days of attempted notification or potential prize winner will be disqualified and an alternate potential winner will be selected at the sole discretion of the Sponsor. Sponsor is not responsible for any prize notification that does not reach the intended recipient due to lack of voicemail, spam filtering or other issues. Return of any prize notification as undeliverable will result in disqualification. Potential winners are subject to verification before the prize will be awarded. In the event that a potential winner is disqualified for any reason, an alternate winner may be selected in a random drawing from all eligible entries received during the Sweepstakes Period, at the sole discretion of the Sponsor. The Sweepstakes participant is solely responsible for entering the Sweepstakes during the Sweepstakes Period and properly claiming a prize if selected as a winner. The reporting and payment of any tax liabilities (federal, state and local) incurred by a prize winner as a result of this Sweepstakes are the sole responsibility of the winner.
Prizes & Approximate Retail Value (“ARV”): One (1) Grand Prize: Free Pizza for a Year. Prize will be awarded in the form of twelve (12) coupons for one (1) Free Hunts Brothers® Pizza product each. Approximate retail value of the Grand Prize is $143.88. No cash equivalents, prize substitutions or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. Any participant who is notified that he or she has won is the potential winner until Sponsor determines, in its sole discretion, that the participant is eligible to win in accordance with these Official Rules.
Conditions of Participation & Certain Restrictions: Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participating, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or any prize (if awarded to him/her) shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in Davidson County, Tennessee, and litigation and/or trials will be decided solely by a judge. ENTRANT WAIVES TRIAL BY JURY IN ANY SUCH ACTION(S). All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Tennessee. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
Privacy: By entering, entrants specifically acknowledge and agree that Sponsor and/or participating retailers may utilize information obtained from entrant in order to contact entrant about a prize in this Sweepstakes.
